1. Purpose

These Terms of Use (the "Terms") govern access to and use of the MediaMonitor media-monitoring service (the "Service"), available at mediamonitor.exnihilolab.com. By creating an account or using the Service, you accept these Terms in full. If you do not agree to them, do not use the Service.

2. Service publisher

The Service is published by a natural person operating under the trade name "ExNihiloLab". The publisher's full details are set out in the legal notice. For any question about the Service: [email protected].

3. Description of the Service

MediaMonitor monitors radio and television streams selected by the user, transcribes them automatically and detects occurrences of the keywords defined by the user. When a mention is detected, the Service sends an email alert that may contain a transcribed excerpt (text context) and a short audio excerpt of the relevant passage.

The Service is offered as a free trial and, where applicable, through paid plans subject to quotas (number of monitored outlets, volume of alert emails, etc.). The features and limits of each plan are indicated on the site.

4. Access, account and free trial

Access to the Service requires the creation of an account (by email and password, or via "Continue with Google"). You undertake to provide accurate information and to keep your credentials confidential; any activity carried out from your account is deemed to be performed by you.

The free trial is provided for evaluation purposes. On expiry of the trial or in the absence of an active plan, the Service may suspend the sending of alerts and the processing of your monitoring configuration, without this giving rise to any compensation. Read access to your account remains available.

The publisher reserves the right to change the quotas, plans and features of the Service. Any material change to the conditions applicable to your account will be communicated to you.

5. Availability and no guarantee of completeness

The Service is provided "as is" and on a best-efforts basis. The publisher does not guarantee exhaustive capture of mentions, the absence of detection errors (false positives or missed mentions), or any specific notification delay. Detection relies on automatic transcription and phonetic matching that are inherently imperfect, and depends on the availability of third-party streams beyond the publisher's control.

The Service may be temporarily interrupted for maintenance, updates, or due to external causes (unavailability of a broadcaster, host or provider). The publisher strives to limit such interruptions but cannot guarantee their absence. Alerts are not a substitute for exhaustive monitoring and must not be the sole basis for a critical decision.

The Service, its brand, interface, texts and software components are protected and remain the exclusive property of the publisher. No rights are granted to the user beyond the right to use the Service under these Terms.

The content of the monitored outlets (radio and television broadcasts) remains the property of their respective broadcasters and rights holders. The transcripts and audio excerpts provided by the Service are supplied solely for personal, internal monitoring; it is your responsibility to ensure that any further use of this content complies with copyright, neighbouring rights and other third-party rights.

The processing of personal data in connection with the Service is described in the privacy policy, which forms an integral part of these Terms.

9. Limitation of liability

To the extent permitted by law, the publisher shall not be liable for indirect damages, nor for consequences arising from an undetected mention, a false detection, a notification delay or a Service interruption. The publisher is not responsible for decisions made by the user on the basis of the alerts.

The publisher shall not be liable in the event of force majeure or events beyond its reasonable control (failure of a third-party stream, network, host or provider). Nothing in these Terms excludes liability that cannot lawfully be excluded.

10. Suspension and termination

You may stop using the Service and request the deletion of your account at any time, under the conditions described in the privacy policy.

The publisher may suspend or terminate a user's access, without notice, in the event of a breach of these Terms, abusive or fraudulent use, or a risk to the security or proper operation of the Service.

11. Changes to the Terms

The publisher may amend these Terms to reflect legal, technical or Service changes. The date of the last update is shown at the top of this page. For material changes, affected users will be informed by an appropriate means. Continued use of the Service constitutes acceptance of the amended Terms.

12. Governing law and disputes

These Terms are governed by French law. In the event of a dispute, an amicable solution will be sought as a priority before any legal action.

Failing an amicable agreement, the dispute will be brought before the competent French courts. In accordance with applicable regulations, consumers may use a consumer mediator free of charge with a view to the amicable resolution of the dispute.
